By accessing our website or using our services, you agree to be bound by these Terms.
eCon Growth provides Command OS, an AI-powered operating system designed exclusively for HVAC business owners. Our services include AI voice dispatch, automated lead follow-up, dispatch management tools, SecondBrain AI reporting and intelligence, tech briefings, estimate generation, and related software features as described on our website.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to active subscribers.
Access to Command OS requires a paid subscription. Subscription tiers, pricing, and features are described on our website and may be updated periodically. Subscriptions are billed monthly unless otherwise agreed in writing. All fees are non-refundable except as expressly stated in our refund policy or as required by applicable law.
You are responsible for providing accurate billing information and for all charges incurred under your account. We reserve the right to suspend access for non-payment after reasonable notice.
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to: use our services for any unlawful purpose; attempt to reverse engineer, decompile, or disassemble any portion of our platform; share, resell, or sublicense access to our services without written permission; use our services in any way that disrupts, damages, or impairs the platform or other users' access.
All content, software, trademarks, and intellectual property associated with Command OS, eCon Growth, SecondBrain AI, and related materials are owned by eCon Growth, LLC. You are granted a limited, non-exclusive, non-transferable license to use our services during your subscription period. You may not copy, reproduce, distribute, or create derivative works without our express written consent.
You retain ownership of your business data and customer data that you input into Command OS. By using our services, you grant eCon Growth a limited license to process this data solely to provide and improve our services. We will not share your business or customer data with third parties except as required to operate the service or as required by law.
Both parties agree to keep confidential any proprietary or non-public information shared in connection with the services. This includes, but is not limited to, business processes, customer lists, pricing, and operational data. This obligation survives termination of your subscription.
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components. AI-generated content, estimates, and recommendations are provided for informational purposes and should be reviewed by qualified personnel before acting on them.
To the maximum extent permitted by applicable law, eCon Growth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services. Our total liability to you for any claims arising under these Terms shall not exceed the amounts paid by you for the services in the three months preceding the claim.
Either party may terminate a subscription with 30 days written notice. eCon Growth may terminate immediately for material breach of these Terms, including non-payment or violation of acceptable use policies. Upon termination, your access to Command OS will cease and we will provide you a reasonable opportunity to export your data.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Salt Lake County, Utah.
We reserve the right to update these Terms at any time. Material changes will be communicated to active subscribers with at least 30 days notice. Your continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.
